Subject: Cr Beaven Notice of Motion: Advice and Reports Prepared for Regional Planning Committee Tangata Whenua Representatives
Reason for Report
1. Councillor Beaven has submitted a Notice of Motion (attached) and the rationale for it, regarding the availability of advice and reports to all members of the Regional Planning Committee.
Process for Considering Notice of Motion
2. Councillor Beaven moves his Notice of Motion, being that “all advice and reports requested by or made available to tangata whenua representatives of the RPC that are currently funded by Council are to be requested and funded through the office of Te Pou Whakarae. All such advice and reports are to be made available for all members of the committee.” and if there is a seconder for it, the Motion is debated in accordance with Standing Orders before being put and voted on.
3. If there is not a seconder, then the Notice of Motion lapses.
4. Following resolution of the Motion (either CARRIED or LOST), the meeting moves to resolve the substantive motion as per the “Recommendations” section following.
Decision Making Process
5. Council is required to make every decision in accordance with the requirements of the Local Government Act 2002 (the Act). Staff have assessed the requirements in relation to this item and advise that the decision to resolve Cr Beaven’s Notice of Motion:
5.1. Will not significantly alter the service provision or affect a strategic asset.
5.2. Does not fall within the definition of Council’s policy on significance.
5.3. Relates to an operational decision delegated to the Chief Executive.
That Hawke’s Bay Regional Council: 1. Receives and considers the “Cr Beaven Notice of Motion: Advice and Reports Prepared for Regional Planning Committee Tangata Whenua Representatives” staff report. 2. Having considered the Decision Making provisions of the Local Government Act and related delegations: Either 2.1. Instructs the Chief Executive to implement a process whereby all advice and reports requested by or made available to tangata whenua representatives of the Regional Planning Committee are to be requested and funded through the office of Te Pou Whakarae, and that all such advice and reports are to be made available to all members of the committee, effective immediately. Or 2.2. Requests that the Chief Executive investigates and implements a process to best ensure that all advice and reports for Regional Planning Committee purposes are commissioned and funded from a single source within Council in accordance with Council procurement processes, and distributed by that same source to all members immediately upon being made available.

Hi James
I wish to have the following notice of motion added to the agenda for Wednesday afternoon’s HBRC meeting.
“That all advice and reports requested by or made available to tangata whenua representatives of the RPC that are currently funded by Council are to be requested and funded through the office of Te Pou Whakarae. All such advice and reports are to be made available for all members of the committee.”
Rationale:
1. HBRC passed a resolution in August 2018 as follows:
All advice and reports prepared for RPC purposes using HBRC funds or resources will be made available to all RPC members.
Since that time Councillor members have not seen or been able to share most of the advice provided by the independent advisers. On occasions advice has been received but it has been delivered at the commencement of RPC meetings or at the last minute. No committee can function effectively in this way.
2. Since that time Pieri Munro has established and staffed the Maori Partnerships office and the provision of advice and how it is provided should be determined by his office and funded through that office.
