Subject: Submissions Received on the Regional Council's Representation Review

 

Reason for Report

1.      This item provides the Council with the submissions received during the consultation period on the Council’s Representation Review.

Consultation Process

2.      The consultation was publicly notified on Wednesday 1 September 2021. Notification and subsequent promotion included a public notice, media release, social media, HB Today advertisements and emails targeted to previous submitters, and the region’s territorial local authorities’ and HBRC’s website.

3.      Consultation closed on Sunday, 3 October 2021.

Submissions Process

4.      Submissions were received online, emailed to the Have Your Say email, and one by post, and are attached.

5.      A total of 36 submissions were accepted, and 15 refused. Submissions refused were emailed as follows.

“Good afternoon,

You have completed an online submission to the Council’s Representation Review, however as it does not relate to any of the aspects of the Council’s representation review being consulted on it is therefore not accepted for consideration by the Council.

This is in accordance with advice from the Local Government Commission that submissions cannot be made on Council’s previous decision to establish one or more Māori constituencies (19 May 2021). That decision was made prior to the representation review process commencing and is outside of the scope of this consultation process.

As stated on our consultation webpage, this Representation Review is to decide the number and boundaries of constituencies and how many councillors will be elected to represent each constituency.

The Regional Council has already decided to keep using the ‘First Past the Post’ electoral system and to introduce one or more Māori constituencies. These matters are not up for debate as part of this Representation Review.

Submissions to the Council’s Initial Representation Proposal can be made on:

·      the names of the Māori and General constituencies

·      whether there should be one or two Māori constituencies and the boundaries if two;

·      the boundaries of the five General constituencies, and

·      the total number of councillors to be elected.

As your submission is not on any of the above aspects of Council’s initial proposal it is not accepted for consideration of the Council.

If you would like to make a new submission relating solely to the aspects of Council’s initial proposal as outlined above please note that submissions close on Sunday 3 October 2021.

Decision Making Process

6.      Council and its committees are required to make every decision in accordance with the requirements of the Local Government Act 2002 (the Act). Staff have assessed the requirements in relation to this item and have concluded:

6.1.      The decision does not significantly alter the service provision or affect a strategic asset, nor is it inconsistent with an existing policy or plan.

6.2.      The persons affected by this decision are those who made written submissions.

 

Recommendations

That Hawke’s Bay Regional Council receives and considers the written submissions received on the “Consultation on the Hawke’s Bay Regional Council Representation Review.

HAWKE’S BAY REGIONAL COUNCIL

Subject: HBRC Representation Review Verbal Submissions

 

Reason for Report

1.      This item provides the Council with information on the hearing for the consultation on the Hawke’s Bay Regional Council Representation Review.

2.      The hearing schedule, as it stands at 6 October 2021, is attached.

Background

3.      The consultation was publicly notified on Wednesday 1 September 2021 and closed on Sunday 3 October 2021. A total of 36 submissions were received, of which 8 indicated they wish to present their submission in person.

4.      A complete set of submissions is attached to the Agenda, with those who want to speak to their submission identified.

Verbal Submissions

5.      The submissions are scheduled to be heard from 12noon on Wednesday 13 October in the Council Chamber.  The Co-Chairs of the Māori Committee and a Tangata Whenua representative of the Regional Planning Committee have been invited to participate in hearing the submissions.

6.      Each speaker has been allocated 10 minutes which includes time for Councillors’ questions, and been offered the option to attend in person or via Zoom.

7.      A finalised schedule of speakers will be provided to Councillors on the morning of 13 October.

Next Steps

8.      After the conclusion of the 13 October meeting, staff will finalise the Deliberation Report for the Council to consider at the 27 October 2021 Regional Council meeting.

9.      The timetable for the remainder of the Representation Review process is as per the table following.
