Subject: Submissions Received on Whether to Establish Māori Constituencies for HBRC for the 2022 Election

 

Reason for Report

1.      This item provides the Council with the submissions received during the consultation period on “whether to establish Māori constituencies for the Regional Council”.

Consultation Process

2.      The consultation was publicly notified on Monday 22 March 2021. Notification and subsequent promotion included newspaper notice, media release, social media, email targeted to relevant organisations and HBRC’s website.

3.      During the consultation period, 5 in-person events were held with over 138 attendees.

4.      Consultation closed on Thursday, 22 April 2021.

5.      Overall, HBRC’s Facebook social media channel sent 10 posts concerning this consultation. Using this channel, HBRC was able to reach:

5.1.      Individuals: 45,382

5.2.      Post engagements: 1,022

5.3.      Links clicked: 1,565

5.4.      Video views: 7,779

Submissions Process

6.      Submissions were received via a number of channels including online, email, posted hardcopy and hand delivered. The submissions, as entered into the submissions tracking system, are attached under separate cover.

7.      A total of 1,090 submissions were received.

8.      The question posed was ‘Do you support the establishment of Māori constituencies for Hawke's Bay Regional Council (to be elected by voters on the Māori electoral roll)?’

9.      The following analysis shows the number of submissions received and the support for the proposal. Note Council did not state a position on a preferred outcome.

9.1.      In support (973):  89.2%

9.2.      Not in support (114):  10.5%

9.3.      Don’t know (3):  0.3%

10.    Submitters were also asked to indicate on which electoral roll they are registered and whether they are a Hawke’s Bay resident or ratepayer:

10.1.    Maori roll (767): 70.4%

10.2.    General roll (293): 26.9%

10.3.    Not registered (30): 2.7%

10.4.    Resident or ratepayer (1022): 93.8%

10.5.    Not a resident or ratepayer (68): 6.2%

Decision Making Process

11.    Council and its committees are required to make every decision in accordance with the requirements of the Local Government Act 2002 (the Act). Staff have assessed the requirements in relation to this item and have concluded:

11.1.    The decision does not significantly alter the service provision or affect a strategic asset, nor is it inconsistent with an existing policy or plan.

11.2.    The persons affected by this decision are those who made written submissions.

Recommendations

That Hawke’s Bay Regional Council receives and considers the written submissions received on the “Consultation on whether to establish Māori Constituencies for Hawke’s Bay Regional Council”.

Reason for Report

1.      This item provides the Council with information on the hearing for the consultation on whether to establish Māori constituencies for Hawke’s Bay Regional Council in time for the 2022 local elections.

2.      The hearing schedule, as it stands at noon on Tuesday 27 April, is attached.

Officers’ Recommendations

3.      Officers recommend that Hawke’s Bay Regional Council follow hearing protocols to receive and consider verbal submissions on the consultation on whether to establish Māori Constituencies in order to inform its decision on 19 May 2021.

Background

4.      The consultation was publicly notified on Monday 22 March 2021 and closed on Thursday 22 April 2021. A total of 1,090 submissions were received, of which 94 indicated they wish to present their submission in person.

5.      A complete set of submissions is attached to the Hearing Agenda under separate cover. Those who want to speak to their submission at the hearing are identified.

Verbal Submissions

6.      The submissions hearing is scheduled to run from 9am to 5pm on Monday 3 May and Tuesday 4 May 2021. The hearing will be held in the Council Chambers.  The Co-Chairs of the Māori Committee and a Tangata Whenua representative of the Regional Planning Committee have been invited to sit on the hearing.

7.      Each speaker has been allocated 10 minutes which includes time for Councillors’ questions. The time limit will need to be strictly adhered to, to enable the large number of submitters who want to be heard to get an equal opportunity to speak.

8.      A finalised schedule of speakers will be provided to Councillors each morning of the hearing. Submitters were able to self-select a hearing time online. Those who didn’t select a time have been allocated a time and followed up with a phone call or email from staff.

9.      A block of time has also been set aside between 3pm and 5pm on Tuesday 4 May to provide an opportunity for those submitters who staff have been unable to confirm a time with but may still wish to speak.

Next Steps

10.    After the conclusion of the hearing, staff will finalise the Deliberation Report for the Council to consider at the Extraordinary Council meeting scheduled on 19 May 2021.
