Parking

1.       Free 2-hour on-road parking is available on Vautier Street adjacent to the HBRC Building & on Raffles Street.

2.       There is free all day parking further afield – on Munroe Street or Hastings Street by Briscoes.

3.       There are limited parking spaces (3) for visitors in the HBRC car park – entry off Vautier Street – it would be appropriate that the “visitors” parks be available for the members travelling distances from Wairoa and CHB.

4.       If you do pay for parking elsewhere, please provide your receipt to the Receptionist for reimbursement – or include with your expenses claim for the meeting.

1.      The Maori Committee Terms of Reference makes allowance for short term replacements (proxy) to be appointed to the Committee where the usual member/s cannot attend.

SUBJECT: Call for Any Minor Items Not on the Agenda        

 

Reason for Report

1.      Under standing order, 9.13:

A meeting may discuss an item that is not on the agenda only if it is a minor matter relating to the general business of the meeting and the Chairperson explains at the beginning of the public part of the meeting that the item will be discussed. However, the meeting may not make a resolution, decision or recommendation about the item, except to refer it to a subsequent meeting for further discussion.

2.      The Chairman will request any items committee members wish to be added for discussion at today’s meeting and these will be duly noted, if accepted by resolution, for discussion as Agenda Item 13.

Subject: Māori Community Views on Māori Representation on Council        

 

Reason for Report

1.      To provide an overview and update to the Māori Committee from the coordinated Hui A Iwi discussions about Maori representation on the Council with the Hapū, Marae and Whānau members within Ngati Kahungunu Taiwhenua regional organisations to enable a recommendation to inform Council’s decision on whether or not to establish Māori Constituencies for the 2019 and 2022 local government elections.

Background

2.      As part of its Representation Review, the Hawke’s Bay Regional Council will first consider whether to establish Māori constituencies in the Hawke’s Bay region. Māori constituencies may be established either by way of a local authority (HBRC) resolution or as the outcome of a poll (referendum) of electors.

3.      If the local authority does make a resolution to establish Māori constituencies it must give public notice of this resolution, including a statement advising that 5% of electors can demand a poll, the result of which may countermand the local authority resolution.

4.      Following the Māori Committee workshop on Friday 15 September, it was agreed that four Hui A Iwi would be coordinated to invite hapū, whānau and marae members to consider this important topic.

Hui A Iwi

5.      Each of the four Taiwhenua would host the hui within their region with Council staff also attending providing technical support.

6.      The four hui were advertised (attached) via local newspapers and social media.

Feedback to date

7.      At the time of writing, only one hui had been conducted with two others scheduled to be held in the following week.

8.      Following is a brief overview of the korero from Te Taiwhenua o Heretaunga hui held on Monday 2 October 2017. Over 20 people attended including Māori Committee, Regional Planning Committee (RPC) Tangata Whenua members and two Councillors.

8.1.      Keen to have Māori representatives at the Regional Council table.

8.2.      Recognise the landscape of change is upon Māori however there is work needed to ensure greater Māori voting participation.

8.3.      It is important that those attending this meeting return to their whānau and marae to promote this discussion.

8.4.      It may be that more conversation is needed to be had before Māori can actively take this korero and position forward- Why is it of Value for Māori/ for others in the region?

8.5.      Te Taiwhenua Heretaunga will be calling another hui to provide feedback and directions from all four of these hui recommendations.

8.6.      A question was asked, “by supporting Māori representative seats on the Council would the Māori Committee (MC) then cease to exist?” The response from Mike Paku was that:

8.6.1.  The MC is in existence at the behest of the current Council therefore at any triennium the committee can be retained or removed.

8.6.2.  The members of the MC wanted to employ this conversation regardless if they are to remain or not - this is about targeting the greater kaupapa of Māori representation.

8.6.3.  There is currently a Statutory Committee of Tangata Whenua the RPC - so it is with confidence that the MC members know Māori voices are at the table.

8.6.4.  The MC of the HBRC has been in existence for over 20+ years and has proven its value so the HBRC would need to consider the removal very carefully.

9.      As stated the other two hui were held and hosted by Te Taiwhenua o Tamatea (9 October 2017) and Te Wairoa Taiwhenua (13 October 2017) so the facilitators of these hui may also want to share feedback to date.

10.    The final Hui A Iwi is to be hosted by Te Whanganui-A-Orotu on Wednesday 25 October 2017.

11.    Once all hui have been completed and the recommendations are collated, the Maori Committee will amalgamate the responses and forward a collective recommendation to the Council for their 15 November 2017 meeting, at which the Council will discuss the next steps.

Considerations of Tangata Whenua

12.    These four hui have provided a voice for Tangata Whenua to actively come to understand, fully participate and consider their aspirations and tools needed to enable their rights and responsibilities to be fulfilled in regards to Māori representation on the Council.

13.    Staff have assessed the requirements of the Local Government Act 2002 in relation to this item and have concluded that, as this report is for information only, the decision making provisions do not apply.

 

Recommendations

That the Māori Committee:

1.      Receives and notes the “Māori Community Views on Māori Representation on Council” staff report

2.      Accepts the update of the Hui A Iwi discussions about Māori Representation on Council and the process to ensure a recommendation is made to the Councilors on 15 November 2017.

Subject: Māori Committee Charter and Membership        

 

Reason for Report

1.      To present the Charter and Terms of Reference, and confirm the membership of the Hawke’s Bay Regional Council Māori Committee for adoption and subsequent recommendation to Council for adoption and signing.

Background

2.      Much discussion has occurred over the last few months regarding the content of the Māori Committee Charter is Attachment 1, and the Terms of Reference (to be tabled at the meeting). Those discussions have included:

2.1.      the strengthening of the Māori Committee to provide stronger strategic advice to the Regional Council within the decision-making process; and the

2.2.      representation appointment process of the committee members, based on the Kahungunu Taiwhenua organisation structure.

3.      Feedback has be sought and received from the membership. The Council now seeks seek final comment/s and input so that the Charter may be prepared for adoption and signing by the two Chairs, Cr Rex Graham, Chairman of Regional Council and Mike Mohi, Chairman Māori Committee.

Considerations of Tangata Whenua

4.      The Māori Committee has been an active advisory committee to the Regional Council over the last 20+ years and plays a critical role in the business of Council in engaging with hapū, marae and whānau.

Decision Making Process

5.      Council is required to make every decision in accordance with the requirements of the Local Government Act 2002 (the Act). Staff have assessed the requirements in relation to this item and have concluded:

5.1.      The decision does not significantly alter the service provision or affect a strategic asset.

5.2.      The use of the special consultative procedure is not prescribed by legislation.

5.3.      The decision does not fall within the definition of Council’s policy on significance.

5.4.      The persons affected by this decision are tangata whenua representatives on the HBRC Māori Committee.

5.5.      The decision is not inconsistent with an existing policy or plan.

6.      Given the nature and significance of the issue to be considered and decided, and also the persons likely to be affected by, or have an interest in the decisions made, Council can exercise its discretion and make a decision without consulting directly with the community or others having an interest in the decision.

 

Recommendations

1.      That the Māori Committee receives and notes the “Māori Committee Charter and Membership” staff report, and:

1.1.      Confirms membership of the Māori Committee includes three representatives each nominated by the Tangata Whenua of Heretaunga Taiwhenua, Wairoa Taiwhenua, Tamatea Taiwhenua and Te Whanganui a Orotu (Napier) Taiwhenua.

1.2.      Adopts the Māori Committee Charter and Terms of Reference as attached and tabled at the meeting.

2.      The Māori Committee recommends that Council:

2.1.      Adopts the Māori Committee Charter and Terms of Reference as agreed at the 17 October 2017 Maori Committee meeting, and attached.

Subject: Central Hawke's Bay Community Delegation Presentation        

 

Reason for Report

1.      To provide the opportunity for Alex Walker, CHB DC Mayor, to present to the Committee on behalf of CHB community members who have expressed a desire to explore options that will mitigate, offset or delay some of the immediate impacts of PC6 that might have been avoided had the Ruataniwha Water Storage Scheme proceeded.

2.      Attachment 1 outlines one of the community’s principal concerns about the impact of new minimum flow limits coming into effect next year.

Subject: GIS Mapping        

 

Reason for Report

1.      This item seeks guidance in relation to how Regional Council staff, specifically the Asset Management and ICT team, can best engage with hapū, marae and whānau to ascertain their knowledge and understand their aspirations within the geographic information system (GIS) mapping framework.

Background

2.      The GIS lets audiences visualise (maps, tables, charts), question, analyze, and interpret data to understand relationships, patterns, and trends.

3.      On the most basic level, GIS is used to create maps.

4.      The real power of GIS is through using spatial and statistical methods to analyse attribute and geographic information. The end-result of the analysis can be derivative information, interpolated information or prioritised information to help with decision- making.

5.      The Regional Council wants to work with the Māori Committee members to identify those forums where Council staff can present and engage with hapū, marae and whānau to ascertain their knowledge and understand their aspirations within the GIS mapping framework.

SUBJECT: October 2017 Statutory Advocacy Update         

 

Reason for Report

1.      To report on proposals forwarded to the Regional Council and assessed by staff acting under delegated authority as part of the Council’s Statutory Advocacy project since the last update in August 2017.  The same update was provided to the Regional Planning Committee on 4 October.

2.      The Statutory Advocacy project (Project 196) centres on resource management-related proposals upon which the Regional Council has an opportunity to make comments or to lodge a submission. These include, but are not limited to:

2.1.      resource consent applications publicly notified by a territorial authority,

2.2.      district plan reviews or district plan changes released by a territorial authority,

2.3.      private plan change requests publicly notified by a territorial authority,

2.4.      notices of requirements for designations in district plans,

2.5.      non-statutory strategies, structure plans, registrations, etc prepared by territorial authorities, government ministries or other agencies involved in resource management.

3.      In all cases, the Regional Council is not the decision-maker, applicant nor proponent. In the Statutory Advocacy project, the Regional Council is purely an agency with an opportunity to make comments or lodge submissions on others’ proposals. The Council’s position in relation to such proposals is informed by the Council’s own Plans, Policies and Strategies, plus its land ownership or asset management interests.

4.      The summary (attached) outlines those proposals that the Council’s Statutory Advocacy project is currently actively engaged in.
