Subject: Draft Regional Land Transport Plan 2015-25 Submissions

 

Reason for Report

1.      This report is to:

1.1.      introduce submissions received on the draft Regional Land Transport Plan 2015-25

1.2.      outline the process for the hearing of submissions

1.3.      make recommendations on the submissions and any consequential changes to the draft RLTP.

2.      Full copies of the submissions are under separate cover as Attachment 1, and summaries and officers’ responses are Attachment 2.

3.      None as a result of this report.

Background

4.      The Land Transport Management Act 2003 (LTMA) was amended in 2013 and now requires regional councils to prepare and approve an RLTP every six years. This plan replaces the Regional Land Transport Strategy and the Regional Land Transport Programme and sets the strategic direction for land transport for the region for at least ten years, as well as forming the region’s funding application to the New Zealand Transport Agency (NZTA) for six years.

5.      The full requirements for and content of the Plan are contained in Sections 14 and 16 of the LTMA. The Plan must be consistent with the Government Policy Statement on Land Transport 2015/16-2024/25 (GPS 2015), which was released in December 2014. The final Plan must be adopted by the Regional Council no later than 30 April 2015.

Consultation

6.      The draft Plan was released for public consultation on Monday 9 December 2014. Over 200 letters were sent to stakeholder organisations and individuals, advising them of the draft Plan’s availability. Copies were made available at all public libraries in the region, at council offices and on the Hawke’s Bay Regional Council website. Public notices were placed in all regional newspapers and radio advertising took place during January. Public consultation closed on Friday 23 January at 5 pm.

7.      Thirty-two submissions were received and fourteen submitters have confirmed that they wish to be heard in support of their submission. Acknowledgement letters or emails were sent to all submitters and they have received a copy of the staff response to their submission. A copy of the final document will be sent to all submitters when it is available.

8.      Each of the submissions received has been summarised in the attached “Summary of Submissions Received” report (Attachment 2), with responses and recommendations provided for each matter raised. The Transport Advisory Group (TAG) has been involved in preparing these recommendations.

Hearing of Submissions

9.      A timetable for hearing of submissions is also provided as part of this agenda. Each submitter who wishes to be heard has been allocated a ten minute speaking time, followed by five minutes to answer any questions the Committee may have. The Committee will hear all the verbal submissions and then deliberate on all the submissions received, taking into consideration the TAG responses.

Next Steps

10.    A revised RLTP, with any changes made in accordance with submissions, will be considered by the RTC at a special meeting on Friday 6 March. If endorsed, the plan will be submitted to the Regional Council for approval on 25 March 2015.

11.    The final approved RLTP will be forwarded to NZTA (via online submission into NZTA’s funding management system Transport Investment Online) by 30 April, where it will be nationally moderated for inclusion in the National Land Transport Programme, which will be released by 30 June 2015.

Decision Making Process

12.    Council is required to make a decision in accordance with the requirements of the Local Government Act 2002 (the Act).  Staff have assessed the requirements contained in Part 6 Sub Part 1 of the Act in relation to this item and have concluded the following:

12.1.   The decision does not significantly alter the service provision or affect a strategic asset.

12.2.   The use of the special consultative procedure is not prescribed by legislation.

12.3.   The decision does not fall within the definition of Council’s policy on significance.

12.4.   The persons affected by this decision are all users of the region’s transport systems.

12.5.   Options that have been considered include no changes to the draft RLTP.

12.6.   The decision is not inconsistent with an existing policy or plan.

12.7.   Given the nature and significance of the issue to be considered and decided, and also the persons likely to be affected by, or have an interest in the decisions made, Council can exercise its discretion and make a decision without consulting directly with the community or others having an interest in the decision.

 

Recommendations

That the Regional Transport Committee:

1.      Agrees that the decisions to be made are not significant under the criteria contained in Council’s adopted policy on significance and that Council can exercise its discretion under Sections 79(1)(a) and 82(3) of the Local Government Act 2002 and make decisions on this issue without conferring directly with the community and persons likely to be affected by or to have an interest in the decision due to the nature and significance of the issue to be considered and decided.

2.      Receives, and acknowledges with thanks, the verbal and written submissions forwarded in response to the draft Regional Land Transport Plan 2015-25.

3.      After hearing verbal submissions, considers and adopts the recommendations contained within the attached ‘Summary of Submissions and Recommendations’ report, subject to amendments agreed to by the Committee.

4.      Agrees to consequential amendments to the draft Regional Land Transport Plan.

5.      Notes that a revised Regional Land Transport Plan, incorporating changes required from this submission process, will be presented to the 6 March 2015 meeting of the Regional Transport Committee for endorsement, and will be referred to the Hawke’s Bay Regional Council on 26 March 2015 for adoption.

Reason for Report

2.      None as a result of these decisions.

Background

3.      The Land Transport Management Act 2003 (LTMA) requires each regional council that intends to subsidise public transport to prepare a Regional Public Transport Plan which must be reviewed at least every three years.  Recent changes to legislation have altered the requirements for these plans; these changes were described in an item at the August RTC meeting.

4.      The purpose of the RPTP is set out in the LTMA  and  is to provide

4.1.      A means for encouraging councils and operators to work together in developing public transport services and infrastructure; and

4.2.      An instrument for engaging with the public in the region on the design and operation of the public transport network; and

4.3.      A statement of –

4.3.1.      The public transport services that are integral to the public transport network; and

4.3.2.      The policies and procedures that apply to those services; and

4.3.3.      The information and infrastructure that support those services

5.      The RPTP must be adopted by the Regional Council by 30 June 2015 at the latest. No re-tendering of bus services is permitted until the Plan is finalised.
