The Chairman welcomed everyone to the meeting and Councillor Pipe offered the prayer.
Dates and topics and/or destinations proposed for upcoming fieldtrips were advised, and feedback to Mike Adye requested.
Council has been advised that High Court appeals on the Plan Change 6 and RWSS Board of Inquiry Decisions will be heard in Wellington for 3 days commencing 10 November 2014.

3. Confirmation of Minutes of the Regional Council Meeting Held on 30 July 2014
Minutes of the Regional Council Meeting held on Wednesday 30 July 2014, a copy having been circulated prior to the meeting, were taken as read and confirmed as a true and accurate record. CARRIED |
4. Matters Arising from Minutes of the Regional Council Meeting Held on 30 July 2014
In relation to Item 9 Code of Conduct Complaint Response Process – the process of resolving the complaint was queried and Councillors advised that the ‘entire’ process and complaint have been referred to legal counsel as per resolution.

In relation to Item 14 Minor Items not on the Agenda – Councillor Hewitt advised that a successful public meeting was held, discussing issues related to the CHB pathways construction and river access.
There were no further matters arising from the minutes.
Report from the Maori Committee Chairman on the Meeting Held 26 August 2014 |

Mr Mohi provided an overview of discussions held at the meeting, including Maori Committee providing input to the Long Term Plan process, presentation of the Mana Ake Iwi Management Plan and providing an outline of the aspirations of the marae for the future. A discussion on approaches and options for building capacity and capability of Maori on RMA included suggestions that a senior Maori advisor role be established to assist with Council planning processes provide appropriate level input into Executive decision making, and establishment of a scholarship by Council to give Maori the opportunity to complete environmental studies. In addition, the Committee is keen to be part of providing workshop for Councillors on Treaty issues to enable them to develop a better understanding of Maori issues. The committee agreed that a that a sub-committee will consider the comprehensive list of suggestions and prepare a paper for Council consideration at a future LTP Workshop. |
1. That the verbal report from the Maori Committee Chairman on the meeting held 26 August 2014 be received. 2. That Council confirms the appointment of Mr Mike Paku (replacing Mr Piri Prentice) as a Maori Committee representative member of the Corporate and Strategic Committee. CARRIED |
Follow-ups from Previous Council Meetings |

Mrs Lambert advised that follow-ups have been completed. There was some discussion of ‘pro forma’ LGOIMA requests originating from the Whale Oil blog site and whether they can be treated as frivolous and refused. All requests for information are dealt with individually and in line with the requirements of LGOIMA, including being assessed for costs where appropriate. |

Recommendations from the Environment and Services Committee |

Councillor Beaven, as Deputy Chairman of the Environment and Services Committee, provided an overview of the discussions traversed at the meeting including development of Pakowhai Country Park and the purchase of some land adjacent, the Land Management Operational plan, soil quality monitoring and the HB Biodiversity Inventory report. There was also discussion around the proposed sale of Lochinver Station. In relation to the purchase of land at Pakowhai it was requested that Council be updated on the balance of funds available in the Open Spaces fund. |
The Environment and Services Committee recommends that Council: 1. Update on Karamu Enhancement Work 2. Delegates authority to the Chief Executive to purchase land in the vicinity of the confluence of the Karamu and Raupare Streams to enable the facilitation of the removal of the old Karamu flood gate structure, provide for the possible expansion of the Pakowhai Regional Park, and potentially to enable an area to be set aside for an urupa; with 70% of the funding being sourced from the Heretaunga Plains Flood Control Scheme – Rivers, and 30% from the Open Spaces borrowing provision. Land Management Operational Plan 2014-15 3. Adopts the Land Management Operational Plan 2014-15. Reports Received 4. The Regional Planning Committee recommends that Council: 1. National Policy Statement for Freshwater Management – Progressive Implementation Report 2013-14 2. Agrees that the National Policy Statement for Freshwater Management – Progressive Implementation Report 2013-14 be re-formatted and published as part of the Council’s 2013-14 Annual Report. New Zealand Coastal Policy Statement: Regional Coastal Environment Plan Gaps Assessment 3. Receives the consultant’s report titled ‘Gap Analysis of Hawke’s Bay Regional Council’s Regional Coastal Environmental Plan against the NZCPS 2010’ (prepared by Mr Rob van Voorthuysen and distributed under separate cover to Councillors). 4. Extends an invitation to the Office of Treaty Settlements to present to the Regional Planning Committee an overview of the law relating to the Marine and Coastal area (Takutai Moana) Act 2011. Financial Report for 12 Months Ended

Mr Drury provided an overview of the contributing reports and the process for release of the Annual Report following audit review as well as the end of year financial results. Mr Drury provided explanations for various queries relating to the Guppy Road building work, CAPEX and other financial results. Mr Collings explained the requirements for the new ‘benchmarking’ section of the Annual Report, along with the information contained within it. There was further discussion about cross referencing Group of Activities Performance Measures to the relevant pages in the Long Term Plan and Annual Plan, providing additional information in the introduction to the Financial Reporting Benchmarks section to explain why it’s being included and where the information has come from, capitalisation of investment funds, and asset classes. The meeting adjourned at 1030 and reconvened at 1045am Discussion traversed erosion or flooding as a result of gravel levels, total costs of remediation of Dalton Street building (including legal and professional costs) in the vicinity of $2.2M, ‘normal’ work of Council being deferred due to resource issues relating to RWSS, effectiveness and/or achievements of the Nature Central strategic partnership, and progress on development of the Regional Biodiversity Strategy. There were additional queries in relation to the Service Levels and Performance Targets and the reforecasting process carried out at 9 months into the financial year (31 March). |
That Council: 1. Confirms the decisions to be made are not significant under the criteria contained in Council’s adopted "policy on significance"; and Council can exercise its discretion under Section 79(1)(a) of the Local Government Act 2002 and make decisions on those issues without conferring directly with the community and persons likely to be affected by or to have an interest in the decision due to the nature and significance of the issue to be considered and decided. 2. Adopts the Draft Annual Report for the period 1 July 2013 to 30 June 2014, subject to any amendments required by Council, for the purposes of audit, with a view to Council adopting the final report at its meeting on 24 September 2014. 3. Resolves that $161,000 profit on external work undertaken by Council's Operations Group during the year ended 30 June 2014 be used by retaining $50,000 for the Operations Group working capital to fund extraordinary expenditures and maintenance, with the remaining $111,000 transferred to Council’s cash operating balances available to fund general funded operating expenditure. Setting of Rates for the 2014-15 Financial Year |

Mr Drury explained that this paper seeks that Council sets the rates as approved in the Annual Plan, in meeting legislative and legal requirements. There was a query in relation to the Calculation Factor (provided by Valuation New Zealand). |
That Council: 1. Agrees that the decisions to be made on the setting and assessing of rates cover information that has been included in the Funding Impact Statement of the 2014-15 Annual Plan as required by Section 95 of the Local Government Act 2002 and further such decisions require special consultative procedures under Section 83 of the Act, such special consultative procedure having been previously carried out on the 2014-15 Annual Plan. 2. Approves the setting of rates for the 2014-15 financial year and sets the following rates under the Local Government (Rating) Act 2002, on rating units in the region for the financial year commencing on 1 July 2014 and ending on 30 June 2015. 2.1. A general rate is set under sections 13 and 131 of the Local Government (Rating) Act2002 on land value as set out following. 2.2. A uniform annual general charge is set per separately used or inhabited part of a rating unit, set under section 15(1)(b) of the Local Government (Rating) Act 2002 as set out following. 2.3. The following differential targeted rates are set under section 16 of the Local Government (Rating) Act 2002 as set out following, including: 2.3.1. Subsidised Public Transport 2.3.2. Heretaunga Plans Control Scheme 2.3.3. Upper Tukituki Catchment Control 2.3.4. Central and Southern Rivers & Streams 2.3.5. Wairoa River & Steams 2.3.6. Various Stream & Drainage Schemes 2.3.7. Animal and Plant Pest Control 2.3.8. Bovine TB Vector Control 2.3.9. Plant Pest Strategy 2.3.10. Healthy Homes – Clean Heat Financial Assistance 2.3.11. Clean Heat & Insulation Loans 2.3.12. Economic Development. 2.4. The following uniform targeted rate is are set under section 16 of the Local Government (Rating) Act 2002 as set out following, including: 2.4.1. Emergency Management. 3. Agrees that the due date for payment of rates as set by the Hawke’s Bay Regional Council for the financial year commencing 1 July 2014 and ending on 30 June 2015 be 1 October 2014. 4. Agrees that, under section 57 of the Local Government (Rating) Act 2002, a 10% penalty be applied to unpaid current rates as at 1 February 2015. 5. Agrees that the rates set for the financial year commencing on 1 July 2014 and ending on 30 June 2015, as set out following, are inclusive of GST. CARRIED |

Mrs Lambert spoke to the paper, outlining the role of the Electoral Officer and the legislative requirement to have an Electoral Officer in place at all times. |
That Council: 1. Agrees that the decisions to be made are not significant under the criteria contained in Council’s adopted policy on significance and that Council can exercise its discretion under Sections 79(1)(a) and 82(3) of the Local Government Act 2002 and make decisions on this issue without conferring directly with the community and persons likely to be affected by or to have an interest in the decision due to the nature and significance of the issue to be considered and decided. 2. Appoints Mrs. Leeanne Hooper of the Hawke’s Bay Regional Council as the Council’s Electoral Officer. CARRIED |
Local Government Elections - Electoral System |

Mrs Lambert explained that legislation requires that Council decides whether to retain the First Past the Post electoral system, or changes to the Single Transferrable Vote for the 2016 election. |
That Council: 1. Exercises its discretion under Section 79(1)(a) and 82(3) of the Act, and make a decision on this issue without conferring directly with the community or others due to the nature and significance of the issue to be considered, and the option available to the public to demand a poll under the Local Electoral Act should they choose to do so and can obtain the necessary number of signatures (5% of the electors). 2. Resolves to retain the status quo and continues with the First Past the Post electoral system. 3. Instructs staff to action the necessary public notices and any other processes required under the Local Electoral Act 2001 in respect to the electoral system for the Local Government Elections 2016. In response to a query, the Chairman advised that there had been no response to the correspondence to the Minister of Transport in relation to reestablishment of the Napier to Gisborne rail line, and acknowledgement of receipt of the letter only has been received from KiwiRail. |
